>> kimberly: hello, everyone. i'm kimberly guilfoyle with bob beckel, eric bolling, dana perino, greg gutfeld. it's 5:00 in new york city. this is "the five." ♪ ♪ >> kimberly: a major announcement this afternoon on a sweeping new deal regarding america's immigration system. bipartisan group of eight senators, four republicans and four democrats, announce an agreement on principle has been reached that includes a path to citizenship for 11 million illegals who live here. one of the members of the group was republican senator marco rubio from florida. conservative, la toy know and possible g.o.p. contender in 2016. >> i think today is an important first step, in what

is going to be a significantly complicated journey. the issue is not simple. there are 11 million human beings in this country that are undocumented. it's not something anybody is happy about or what they want to see happen but it's what happened. we have obligation and needs to address the reality of the situation that we face. >> kimberly: well l the white house play ball? here's jay. >> we will be working with congress, with both houses, both parties to help bring about a result that is a detailed, specific bill. that can win bipartisan support, in congress. and that this problem can sign that meets the very specific principles the president put forward. >> kimberly: what did you think of the press conference? >> dana: interesting and good first step to deal with a major problem. the first report that came out of it was how positive it was and this would sail through.

we'll get it done and wrap it up by the summer. that is what senator schumer said. talking to people today, i think that while the principles are good, taking principles and putting them to legislative text is a very different thing. also, a little bit of an inside washington point but it is important. this legislation would have to go through senator bob le pat ha lean's committee. the problem from the left will be greater because they say the principles are not good enough to protect human rights. >> kimberly: okay. too difficult perhaps for the left to support. might be problematic. eric? >> all of this is predicated on making sure the borders are secure. we have known for the past 70, 80, 150 years we can't secure the border. this is interesting to say it's batesed on the secure board first. the g.o.p. has a problem. how do you not alienate the

hispanic vote? they need to get it back to bush levels of 40% to win another presidential election. i'm not sure giving amnesty type of program to 11 million or more illegals in the country already is the way to do it. i think they need to address it. in my opinion there needs to be a different way. >> kimberly: greg, do you have a suggestion? >> greg: i don't. i am with eric, though. how can you have a comprehensive immigration plan without a boarder in place. it's like buying a truckload of stuff and realizing you don't a truck. then you to take all of that stuff and carry it outside. what do you do? nothing. i am going to beat the metaphor to ground. half of the immigrants are coming from a country and it's not canada. it's like a kid that came to play at your house but never

played at his house because it didn't have a pool. mexico has to figure out what they will do after the comprehensive immigration plan because they will lose everybody. they have to fix their country. people are great. the councilmembe country not so. i have an above ground pool. >> bob: a great start but obstacles. first, the definition of what secures the border will be difficult one to determine. they will leave it up to governors of the southwest to do that. it could be politically difficult. right time to do it. republicans know they have to have more hispanic voters. that is propelling this forward. three, i think the question good things in here. if you graduate from an american university and you have the things we need, engineering, chemical and math matt mick -- mathematics you can say and get a green card.

>> eric: be realistic, bob. how many illegals here right now have an advanced degree? bops not that many but the ones that are getting through, we have been fortunate they go back home. better to stay here and practice the trades here than go back to china or back to india. there will be a difficult thing. what does it mean you have to have the, the employers have to assure that they are not hiring anybody illegal? the system is not in place -- >> eric: what is illegal anymore. >> kimberly: they are not enforcing the law. >> eric: so you have e verify system. it's illegal. everything i'm reading, it sounds like you can drive. you will get a green card. you pay a fine. let's say that they push this through. it gets through senate and works its way in the next six or eight months by the time they get it to law.

how many illegals will come across the border to say i want in under the umbrella? >> dana: i disagree that some employers in particular, i don't think anyone should fall in a trap of saying well, we will try to protect the high-skilled workers. high-skilled workers will do well no matter where they are in the world. if they want to make a home in america, we should welcome them to do that. the reason people come here is hope and opportunity. i don't care how big the border is you won't prevent someone who wants to provide for their family, you won't prevent them getting here. 11 million that are here, they are not going home. there is not a rational way to deport all of them. you might pay a fine or back taxes or make sure there is a penalty against them. >> eric: how about requiring a year of military service in you are here illegally and you want to stay. >> kimberly: but it operates as disincentive because you

reward someone who broke the law. we have to deal with this. do you throw up the white flag and say we will find a way to stay here. you have to think about the cost associated with the healthcare. everything else that hasn't been factored in. >> bob: remember, they would not be qualified for medicaid or any government assistance until they got in the line and process. put in the back of the line, they are fine. they have to pay back the taxes. the reality, you are not going to do anything with the 11 million. republicans can say all they want about it, the anti-immigration republicans say all they want but a fool's game. they can't stop it. >> greg: the fear here is we want people to come here and love america. we want people to understand freedom. not free stuff. this is a country, not a game show where the point, the moment you walk in you get stuff. my fear is that ethnic politics has changed the country so it's not a melting pot. it's a pie of preferences. it's no longer the u.s.. it's you versus me. you are not an american.

you are a black or hispanic. you are gay. you are straight. that's what worries me. we may be sacrificing this idea of patriotism in american unity before -- we have to teach people who are coming here why this place is special. >> kimberly: to love it. >> greg: it's not about the free stuff. it's about the freedom. >> kimberly: i agree. >> greg: i want to talk about something i find concerning about the left. the left is worried about the low-income workers. we do have a problem with jobs. you have low-skilled work herbs coming in to take over the low skilled workers. i don't know why the left won't get upset with that. perhaps they think there is no low-skilled worker who wants to be a junk professor to blog in the spare time. >> dana: i do think they are upset about it. it's a reason the bill in 2007 didn't go through. on the left they said there were concerns by people, union groups that it didn't go far enough or cause a problem.

economically it's a two-way street. we have all benefit from the low-skilled workers do job that help us be able to -- >> greg: i'm one. >> dana: more investment. i would like to invest in more things. i don't want people to come here illegally. i want them to come here legally and for the right reasons. >> eric: hold on. if you don't want them to come here illegally, shouldn't -- are you okay with them staying here illegally? >> dana: i think the issue is banning guns. we're going to ban assault weapons like a magic what happened and they are all going go away. the same with illegal aliens. i would rather bring them in. make sure they want to be here. >> bob: v we have been sending them home, after they get

degrees and training them to go back and work against us. the employers have to guarantee they are not replacing american jobs. the undocumented workers have no plan whatsoever to get the 11 million people back. this make sense now. if it weren't for the election it would haven't happened. good. go forward. >> greg: i have a plan. go back to the idea of trading people. i will take 10,000 people from mexico if they take chris brown. >> kimberly: not so helpful. let's talk about something else. >> greg: that is a great point. if there was a melting pot, you could make fun of each other. they were proud of the ethnic differences. the one thing about if the plan comes to pass, how are

i'm bret baier in washington. the big story hereoday is a first step on comprehensive immigration reform. tonight, on "special report," group of eight bipartisan senators unveils a plan to fix a broken system. it would create a path to citizenship for many of the 11 million illegal immigrants in this country.

it would also provide incentives for highly essentialcated immigrants to stay. and allow businesses to employ low-skilled workers. the question is: would it pass? stocks were off today. but they are still having a big month. we look at whether the success on wall street is trickling down to main street. some democrats are using a new strategy to go after the gun manufacturerrers, they are targeting the banks that loan them money. be prepared for a big change in the boy scouts. the group is considering adjustment to the long standing and controversial policy excluding gays. brit hume has analysis of the obama media strategy. "special report" starts at 6:00. now back to "the five." ♪ ♪ >> dana: welcome back. today is national school choice day. greg, stop being a jerk.

i'm trying. school choice week, what does it mean? this is about parents and movement across the country and different places and ways where the parents who are dissatisfied with their children's school, they could figure out how to send them to another school. one of our co-host juan williams is a big proopponent of charter schools in particular. as mom in the city dealing with this, you have a different situation you can look around, though you have to deal with hoops and get your child in the right school. you have means to do that. but juan talk about people like you who live in city and pay property taxes should you have an option for public schools but people of low income should be able to look at their schools and say i'm not going to send my kid there. i want another option. that's what this is all about. >> kimberly: a good point. every child deserves an excellent education. it should not be predetermined by what your parents or providers, socioeconomic

status is and whether you can afford to pay the exorbitant bills for private schools. they are not cheap. ronin was in public school but there are so many kids in the class i think one day they lost the little guy. you have don't stand out. if you need extra help it's difficult to get it. great teachers, mean well, but they are challenged by the numbers. you go to private school but who is able to afford that? some schools are financial aid assistance there. has to be an alternative that you don't the children educationmly discriminated against because they can't afford a $45,000 or $60,000 school. >> dana: that is a great point. the way you put it in terms of being discriminated against. we're from d.c. but i moved up here and you have a place up there, bob. one of the programs the school choice program in d.c., voucher program, very popular amongst a lot of people. ended under president obama and john boehner got it back in. do you think the unions are

nervous with the school choice week they have 3600 events taking place nationwide. it seems to be gaining steam. >> bob: sure. but there are things to consider here. if you take the charter school students and the ones that get vouchers for private schools there are still 49 million students left in public schoo schools. the question is what can we do to make the school better. i think the voucher system works. i talked to juan a lot. there is a place for more charter schools but the money is expensive. >> dana: when it comes to the money and managing the school what is could make a difference for a lot of school districts? how do we figure out how the property tax goes to make sure the kids are well educated and parents don't have to be forced. >> eric: the left doesn't want to hear it but performance, let the teachers be -- compensation be based on

performance of the students. the only way to do it. you weed out the poor performers and public schools will start to be able to compete with the private schools. right now, the private schools, the numbers are staggering. the difference between where the students are with public versus private. even it out so that everyone doesn't want to go to a private school because they get a better education. >> dana: charter schools are the one that the parents are active. public schools research shows students participatin participae school choice program do better in school. in florida, 93% of parents whose parents participate in program are happier with the scholarship program than before because the kids are well taken care of. you are a good, honest critic about unions. do you think it has to do with them? >> greg: i home school my son sven. he is 18 years old. i adopted him last week off craigslist. it's amazing. classroom without competition

is day care center for dependents. this is not about students. many is about teachers. nif teacher scared of school choice is incompetent teacher. competition is the only factor leave to im -- lead to improvement on all walks of life. everywhere you go, only way to improve life is through competition. left is pro-choice before the kids are born. >> bob: the idea of you home schooling somebody is the next step in the education process the bellevue psychiatric ward. they say in the report they're marginally educated in charter school but it raises question of cost, of course. but already, across the country there are performance tests for teachers based on how the students do. >> eric: i can, i would like to push back on that. >> bob: you can push back -- >> dana: certainly not -- >> bob: listen, the unions opposed it. i agree. there are places that have

broken through and done that. >> dana: governor mitch daniels of indiana did a revamp of the school choice program there. a lot of the schools, all the schools are better. >> greg: do you have proof of that? >> dana: i do. i read earlier. i have to tease. >> eric: what did sven major in? >> greg: sven is in the hospital now. accident. sven is trying to be a personal trainer. >> greg: is he the same -- skims the he the guy that was my private snowboarding instructor? his name was sven. >> dana: san francisco is going to new orleans. the mayor of san francisco doesn't want "knucklehead to vantize the city after the giants won the world series last year." what is his plan to prevent the chaos? will it work? we'll discuss it when we come back. ♪ ♪

♪ ♪ >> bob: president obama says he is a football fan but said if he had a son, he probably wouldn't let him play football. i have thoughts. start with eric. what do you think? >> that picture, he throws like a girl. i can understand why he wouldn't want him to play football michigan thought, he doesn't want to play football. what do you want in touch football? if we had a nation of obama men, i guess that would make a good case for putting women on the front line. >> dana: on the debate team they thought i might cut my teeth on my sharp tongue. i wrote that earlier. i agree. if i had a child, which i don't, i might be risk averse when you see -- you don't want your child to get hurt. although they do wear a lot of pads and football. helmets.

[ laughter ] >> greg: running out of steam. >> bob: i'm just, i -- my son came to me in his freshman year of high school and said he wanted to play football. he knew i played football for a lot of years. he tried and said it's a tough game. i said stick with golf. you know what you are doing. singularly the most difficult and dangerous game to be played. those of white house played it now, many years later we suffer consequences of it. if i had a son, i don't want you to play the game. i'll repeat this. i'm a huge football fan and player and i people have gotten so big, the rules have gotten so loose. coaches have gotten so nasty. too dangerous. >> greg: can i disagree completely with everything? president obama is misreading risk. playing football. or playing any extracurricular activity better than not. when you look at the participation in the criminal activity.

there are more cheerleading injuries on the sideline than football injuries. the other big point is it's a big message about risk in general. the media portrays conservative as risk averse and liberals as adventurous. the fact is it's the left that is so scared of something happening that you have to have a safety net cradle to grave. >> bob: would you let your son play? >> kimberly: yes. i love football. i like to play football. >> bob: not just a question of injuries. >> eric: you don't want your son to get hurt. tell him to play quarterback or position they don't -- don't -- >> kimberly: kicker. >> bob: i feel like the -- [ overtalk ] >> greg: you can't eliminate all risk. >> bob: are you calling me a wuss; is that it? >> eric: kind of. >> bob: we'll settle that later. the mayor of san francisco said he wants to close the bars on super bowl because of what happened when san francisco won the world series. >> kimberly: not my husband.
